Florida 2026 Bills Filed

The 2026 Legislative Session has begun!

Committees in both the House and the Senate have begun meeting and bills that affect healthcare and nursing have been filed. Below is a partial list of significant legislation that has the potential to impact our profession or our profession.

When you look at legislation that has been filed remember the requirements for a bill to become law:

  1. The Bill has to pass in all the committees assigned to hear the bill
  2. The Bill must pass in both the House and Senate
  3. The Governor must either sign the Bill or not veto the Bill

It is important for you to reach out to the sponsors of the legislation and the Committee members hearing legislation to share your perceptions of the proposed legislation. Only by sharing our opinion with policy makers can we influence laws that might impact our profession.

SB 38: Parity for Non-nursing Services Under Long-term Managed Care Plan

Parity for Nonnursing Services Under Long-term Managed Care Plans; Beginning on a specified date, requiring the Agency for Health Care Administration to reimburse nonnursing services provided by licensed providers at the same rate or higher than the rate it reimburses unlicensed providers for such services under the Medicaid long-term managed care program; requiring the agency annually to adjust the rate for licensed providers, etc.

SB 42: Specific Medical Diagnoses in Child Protective Investigations
GENERAL BILL by Sharief
Specific Medical Diagnoses in Child Protective Investigations; Providing an exception to the requirement that the Department of Children and Families immediately forward certain allegations to a law enforcement agency; requiring a child protective investigator to inform the subject of an investigation of a certain duty; requiring Child Protection Teams to consult with a licensed physician or advanced practice registered nurse when evaluating certain reports; authorizing, under a certain circumstance, a parent or legal custodian from whom a child was removed to request specified examinations of the child, etc.

Provides exception to requirement that DCF immediately forward certain allegations to law enforcement agency; requires child protective investigator to inform subject of investigation of certain duty; requires Child Protection Teams to consult with licensed physician or advanced practice registered nurse when evaluating certain reports; authorizes, under certain circumstance, parent or legal custodian from whom child was removed to request specified examinations of child; requires that certain examinations be paid for by parent or legal custodian making request or as otherwise covered by insurance or Medicaid; prohibits request of examination for specified purpose.

SB 36: Use of Professional Nursing Titles
Use of Professional Nursing Titles; Authorizing persons who hold specified licenses to practice professional nursing or to perform nursing services to use certain titles and abbreviations; requiring doctoral degree holders to specify their profession when using a specified title, etc.

Nursing Education Programs : Revises application requirements for nursing education program approval; authorizes Board of Nursing to revoke program’s approval; revises requirements for annual reports program directors of approved programs are required to submit to board; provides for revocation of program’s approval & discipline of its program director; revises remediation procedures; removes provision authorizing board to extend program’s probationary status; authorizes agents of DOH to conduct onsite evaluations & inspections; authorizes DOH to collect evidence as part of such evaluations & inspections; removes provision authorizing approved nursing education programs to request extension to meet board’s accreditation requirements

Nonparticipating and Out-of-network Nurse Registries and Home Health Agencies: Prohibiting state group health insurance plans and state-contracted health maintenance organizations, the Agency for Health Care Administration, Medicaid managed care plans, individual health insurers, and health maintenance organizations, respectively, and any persons responsible for administering claims on behalf of such plans, organizations, agency, or insurers, from restricting participants, recipients, enrollees, policyholders, and subscribers from obtaining care from nonparticipating or out-of-network licensed nurse registries or home health agencies; revising applicability for group health insurance, blanket health insurance, and franchise health insurance, etc.
